RELATING TO THE APPROPRIATION TO THE PUBLIC SCHOOLS EDUCATIONAL SUPPORT PRO-

GRAM'S DIVISION OF CENTRAL SERVICES; APPROPRIATING MONEYS TO THE PUBLIC
4
SCHOOLS EDUCATIONAL SUPPORT PROGRAM'S DIVISION OF CENTRAL SERVICES FOR
5
FISCAL YEAR 2023; APPROPRIATING GENERAL FUND MONEYS FOR TRANSFER TO THE
6
PUBLIC SCHOOL INCOME FUND; DIRECTING THE USE OF MONEYS FOR LITERACY PRO-
7
GRAMS, INTERVENTION SERVICES, MATH INITIATIVE PROGRAMS, AND LIMITED-
8
ENGLISH PROFICIENCY PROGRAMS; DIRECTING THE USE OF MONEYS FOR STUDENT
9
ASSESSMENTS; DIRECTING THE USE OF MONEYS FOR PROFESSIONAL DEVELOPMENT;
10
PROVIDING REQUIREMENTS FOR DIGITAL CONTENT AND CURRICULUM; PROVIDING
11
GUIDANCE ON YEAR-END RECONCILIATION; PROVIDING REQUIREMENTS FOR TECH-
12
NOLOGY CONTENT AND CURRICULUM; DEFINING "DISTRIBUTED" AND "EXPENDED";
13
REQUIRING AN ACQUISITIONS REPORT; TRANSFERRING MONEYS FROM THE GENERAL
14
FUND TO THE PUBLIC SCHOOL HEALTH INSURANCE PARTICIPATION FUND; CLARI-
15
FYING THE ORIGINAL FUND SOURCE FOR EXPENDITURES FOR THE PUBLIC SCHOOLS
16
EDUCATIONAL SUPPORT PROGRAM'S DIVISION OF CENTRAL SERVICES FOR FISCAL
17
YEAR 2023; AND DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE.

Be It Enacted by the Legislature of the State of Idaho:
19
SECTION 1. There is hereby appropriated to the Public Schools Educa-
20
tional Support Program's Division of Central Services $12,587,600 to be ex-
21
pended for operating expenditures from the Public School Income Fund for the
22
period July 1, 2022, through June 30, 2023.
23
SECTION 2. There is hereby appropriated and the Office of the State
24
Controller shall transfer $12,587,600 from the General Fund to the Public
25
School Income Fund on July 1, 2022, or as soon thereafter as practicable for
26
the period July 1, 2022, through June 30, 2023.

SECTION 3. PROGRAM SUPPORT. Of the moneys appropriated in Section
28
1 of this act, up to $2,459,100 from the Public School Income Fund shall
29
be expended for the support of literacy programs, intervention services
30
for non-Title I schools that fail to achieve proficiency on Idaho's stan-
31
dards-based achievement tests, math initiative programs and regional math
32
labs, and evaluation of the programs for students with non-English or lim-
33
ited-English proficiency. The State Department of Education shall report to
34
the Joint Finance-Appropriations Committee, the Senate Education Commit-
35
tee, and the House Education Committee by January 13, 2023, on the uses of
36
funds and effectiveness of the programs and efforts.

SECTION 4. STUDENT ASSESSMENTS. Of the moneys appropriated in Section
38
1 of this act, the State Department of Education may expend up to $2,258,500
39
for the development or administration of student assessments, including a
40
college entrance exam for grade 11 students, an exam for grade 10 students

that provides preparation for the college entrance exam, and end-of-course
2
exams for high school science subjects.

SECTION 5. PROFESSIONAL DEVELOPMENT. Of the moneys appropriated in
4
Section 1 of this act, the State Department of Education may expend up to
5
$2,500,000 for professional development and teacher training and to track
6
usage and effectiveness of professional development efforts at the state and
7
local levels.

SECTION 6. CONTENT AND CURRICULUM -- DIGITAL CONTENT. Of the moneys
9
appropriated in Section 1 of this act, $1,200,000 shall be expended for
10
the purchase of content and curriculum for adaptive math instruction, and
11
$2,250,000 shall be expended for research-based programs to assist with the
12
instruction of students with non-English or limited-English proficiency and
13
for learning loss.

SECTION 7. YEAR-END RECONCILIATION. If the moneys appropriated and
15
transferred to the Public School Income Fund and the moneys appropriated
16
from the General Fund in Section 1 of this act exceed the actual expenditures
17
for the specified purposes, the difference shall be included in the year-end
18
reconciliation used to calculate funding available to meet the requirements
19
of Section 33-1018, Idaho Code, notwithstanding any other provision of law
20
to the contrary. If the funding amounts specified in Section 4 of this act
21
are insufficient to meet the actual expenditures, the difference shall be
22
included in the year-end reconciliation used to calculate funding available
23
to meet the requirements of Section 33-1018, Idaho Code, notwithstanding any
24
other provision of law to the contrary.

SECTION 8. CONTENT AND CURRICULUM -- TECHNOLOGY. Of the moneys appro-
26
priated in Section 1 of this act, an amount not to exceed $1,570,000 from
27
the Public School Income Fund may be expended by the State Department of Ed-
28
ucation to contract for services that provide technology education opportu-
29
nities and/or information technology certifications to students, including
30
faculty, that prepare students for college, career, or the workplace. Fund-
31
ing shall be awarded for projects that include three (3) or more of the fol-
32
lowing components:
33
(1) Certification of skills and competencies;
34
(2) Professional development for teachers;
35
(3) Integration with curriculum standards;
36
(4) Online access to research-based content and curriculum; or
37
(5) Instructional software for classroom use.

The State Department of Education shall provide a report to the Joint Fi-
39
nance-Appropriations Committee, the Senate Education Committee, and the
40
House Education Committee by January 13, 2023, regarding the number and type
41
of certificates earned by students and faculty.

SECTION 9. DEFINITIONS. For the purposes of this act, "distributed"
43
means moneys that are transferred to school districts and public charter
44
schools, with no funds withheld for any other contract or administrative
45
costs. "Expended" means moneys that pay for the cost of contracts that pro-

vide services to school districts, public charter schools, or students or
2
that pay for the State Department of Education's cost of administering the
3
programs for which the moneys are allocated.

SECTION 10. ACQUISITIONS. Consistent with the provisions of Chapter
5
92, Title 67, Idaho Code, the State Department of Education is encouraged
6
to engage in open, competitive acquisition processes. The State Department
7
of Education shall provide a report to the Joint Finance-Appropriations
8
Committee by December 1, 2022, on all contracts signed during fiscal year
9
2022 for property valued at more than $25,000. The report shall include
10
for each contract: (a) the amount; (b) the duration; (c) the parties; (d)
11
the subject; (e) whether the contract was awarded as a result of an open,
12
competitive acquisition process or as a sole source or other noncompetitive
13

for signing any sole source or other noncompetitive procurements.

SECTION 11. CASH TRANSFER. There is hereby appropriated and the Office
16
of the State Controller shall transfer $75,500,000 from the General Fund to
17
the Public School Health Insurance Participation Fund on July 1, 2022, or as
18
soon thereafter as practicable, for the period July 1, 2022, through June 30,
19
2023.

SECTION 12. Of the amounts appropriated in Section 1 of this act for the
21
Public Schools Educational Support Program's Division of Central Services,
22
$12,587,600 shall be considered expended from the General Fund for the pe-
23
riod July 1, 2022, through June 30, 2023.

SECTION 13. An emergency existing therefor, which emergency is hereby
25
declared to exist, this act shall be in full force and effect on and after
26
July 1, 2022.
